Hold My Beer

By signing this Waiver and Release of Liability (Agreement), I waive and release AirB 'N' Beer LLC dba Hold My Beer, its agents, servants, employees, insurers, successors and assigns from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims for personal injury, property damage, and medical expenses, arising from my presence or participation at any Hold My Beer event or activity, whether at our permanent location or any off-site or mobile event location.

This waiver and release is intended to and does release AirB 'N' Beer LLC dba Hold My Beer from liability for damages or injuries arising from my own negligence, the negligence of third parties, or Hold My Beer's negligence. This is not intended to release Hold My Beer from liability resulting from intentional misconduct.

I agree not to bring any legal action against AirB 'N' Beer LLC dba Hold My Beer for any claim covered by this Agreement, and agree to fully indemnify Hold My Beer for all costs, including attorney's fees, incurred as a result of any such claim.

I understand that AirB 'N' Beer LLC dba Hold My Beer is not responsible for any lost, stolen, or damaged personal property. I agree to comply with all Hold My Beer rules and regulations and any amendments.

I ACKNOWLEDGE THAT ALL ACTIVITIES OFFERED BY HOLD MY BEER, INCLUDING BUT NOT LIMITED TO AXE THROWING, CORNHOLE, OUTDOOR EVENTS, AND ANY MOBILE UNIT ACTIVITIES, ARE INHERENTLY DANGEROUS. I understand that I could suffer property damage, injury, or death as a result of participation. I accept all risks, confirm I have adequate medical coverage, and acknowledge I have no medical condition preventing safe participation.

I confirm I am not intoxicated upon arrival and accept full personal responsibility for my alcohol consumption and its effect on my participation. I confirm I am not experiencing symptoms of illness that could affect my safety or the safety of others. In the event of a medical emergency, I authorize Hold My Beer staff to contact emergency services on my behalf and consent to emergency medical treatment. I agree to bear all associated costs. Hold My Beer staff reserve the right to remove any participant from an activity at any time if their condition poses a risk to themselves or others, without refund.

I UNDERSTAND that by executing this Agreement I am 18 years of age or older and have read and understand this Agreement. Hold My Beer reserves the right to verify age with a valid government-issued ID. FOR PARENTS/LEGAL GUARDIANS OF PARTICIPANTS UNDER THE AGE OF 18: I CERTIFY THAT I, as a parent/legal guardian, consent to the above release on behalf of my minor child, confirm I have legal authority to do so, and accept full responsibility for their conduct and safety. This release applies to minor children of all ages, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent provided by law.

I give Hold My Beer permission to take photos and/or video of me and/or my minor child for social media and advertising purposes only, not to be sold or shared with any other party. By providing my contact information, I consent to receive promotional emails, SMS messages, and marketing communications from Hold My Beer. I may opt out at any time. Message and data rates may apply.

I agree that any disputes arising from this Agreement shall be resolved by binding arbitration in Kenosha County, Wisconsin. Either party may seek emergency injunctive relief in court if necessary. This Agreement is governed by Wisconsin law. If any provision is found unenforceable, all remaining provisions stay in full force. My electronic signature is legally binding and equivalent to a handwritten signature.

I have read this Agreement in full, understand that signing waives certain legal rights, and am signing freely, voluntarily, and competently. I am eighteen (18) years of age or older.
